Plain-English summary: Your notes stay on your own device — we never receive or store them. There is no account and no server. We collect only the minimum needed to run the beta (basic access and technical data). No AI reads your notes. We don’t sell anything.

1. Scope

This Policy explains how ThinkingSchematics, Inc. (“we,” “us”) handles information when you use the Visual Note System beta (the “Service”). It applies only to this Service.

2. Information We Collect

Your notes — NOT collected. Your content is saved locally (in the app’s local storage and as .verse / JSON files) on your device. We do not receive, transmit, or store it.
Access info: the beta key or invite (and an email address, if you were invited by email) used to enter the beta. Beta keys are checked entirely on your own Mac — entering one sends nothing to us.
Usage & technical data: standard data such as IP address and device type, collected automatically by our infrastructure providers (e.g. Cloudflare) when you download the app or it checks for updates.

3. How We Use Information

To operate, maintain, and secure the Service.
To respond to you and provide support.
To understand how the beta is used so we can improve it.
To comply with legal obligations.

4. AI & Automated Processing

No AI processing. No AI system and no automated process of ours reads, analyzes, or processes the content of your notes. Your notes are not used to train or improve any model.

Your operating system may offer its own AI features in text menus (for example, Apple’s “Writing Tools” on macOS). Those are system features provided and processed by Apple under your own macOS settings — they are not part of the Service, and we receive nothing from them.

5. Where Your Data Is Stored

Your notes: stored only on your own device. They never leave your computer through the Service.
Google Drive backup (retired): the app no longer connects to Google Drive at all — it neither sends backups there nor reads old ones, and the in-app restore has been removed. Backups you made while that feature was available remain in your own Google Drive account, under your control; we never receive or store them.
Local rescue copies: before risky storage operations the app saves rescue copies of your universes (.verse files) in its own Application Support folder (Help → Show Safety Copies). These never leave your device.
Live Calendar (opt-in): if you connect a calendar feed, the app fetches events directly from your calendar provider (e.g. Google, Outlook, iCloud) to your device, read-only. The feed’s secret address is stored only in your Mac’s Keychain; events are cached only on your device and never included in backups, exports, or problem reports. We never see your calendar.
Problem reports (manual): the “Report a Problem” button creates a diagnostics file on your Mac containing technical logs only — never your notes, drawings, titles, calendar events, or keys — and shows you exactly what’s inside. Nothing is sent unless you choose to email it.
Downloads & updates: the app and its updates are delivered from Cloudflare’s infrastructure, which logs standard technical data (e.g. IP) to deliver and secure them.

6. How We Share Information

We do not sell your personal information.
Service providers: we share limited technical data with vendors who help run the Service (e.g. Cloudflare) under appropriate terms.
Legal: we may disclose information if required by law or to protect rights, safety, and security.
Business changes: if the company is acquired or merges, data may transfer as part of that transaction.

7. Data Retention & Deletion

Your notes: you control them — delete the app’s data or your .verse files at any time. We hold no copy.
Access and technical data is kept only as long as needed to run the beta, then deleted or anonymized.
To remove any access info we hold (e.g. your invite email), email us (see Contact).

8. Security

Because your notes stay on your device, their security depends largely on your own computer. The one secret the app does hold (a connected calendar’s address) lives in the macOS Keychain. We use reasonable measures to protect the limited data we handle, but this is a beta and no system is fully secure. Protect your device and keep backups.

9. Your Choices & Rights

You can access, correct, or delete data we hold by contacting us.
Depending on where you live, you may have additional rights (e.g. under GDPR or US state privacy laws). We will honor valid requests as required by law.

10. Children’s Privacy

The Service is not directed to anyone under 18, and we do not knowingly collect data from children. If you believe a child has provided us data, contact us and we’ll delete it.

11. International Users

The Service is operated from the United States. If you access it from elsewhere, you consent to processing of your data in the United States, where privacy laws may differ from your own.

12. Changes to This Policy

We may update this Policy. Material changes will be communicated to beta users by reasonable means. Continued use after changes means you accept the updated Policy.

Plain-English summary: This is an early, experimental version of Visual Note System. It may break, change, or be shut down at any time. Your notes are saved on your own device — we don’t store them — so backing them up is on you. You keep ownership of your notes; we keep ownership of the software.

1. Acceptance

By accessing or using the Visual Note System beta (the “Service”), you agree to these Terms. If you do not agree, do not use the Service. “We,” “us,” and “our” mean ThinkingSchematics, Inc.

2. The Beta — What You’re Getting

The Service is a pre-release, experimental product offered for testing and feedback.
It is provided free of charge during the beta period.
Features may be incomplete, change, or be removed without notice.
The Service may be unavailable, unstable, or contain bugs.
We may end the beta, or your access to it, at any time for any reason.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you are.

4. Access & Beta Keys

Access is granted via a beta key or invite. Keep yours confidential.
Don’t share your key or forward your invite without prior permission.
You are responsible for activity that occurs under your access.

5. Your Content & Ownership

You own your notes. Content you create (“Your Content”) remains entirely yours.
Stored on your device. The Service saves Your Content locally on your own computer. We do not receive, store, or keep a copy of your notes on our servers.
No AI or automated processing. No AI system and no person at ThinkingSchematics reads, analyzes, or processes the content of your notes during the beta.
Because your notes live on your device, you are responsible for managing and backing them up.

6. Acceptable Use

You agree not to:

Use the Service for anything illegal, harmful, or infringing.
Upload content you don’t have the rights to, or that violates others’ privacy or IP.
Attempt to reverse engineer, scrape, overload, or disrupt the Service.
Resell or commercially exploit the Service during the beta.

7. Our Intellectual Property

The Service — including its software, design, branding, and the ThinkingSchematics, Visual Note System, and VisualThinking.Space names and logos — is owned by us and protected by U.S. copyright and trademark law. © 2026 Thinking Schematics, Inc. Thinking Schematics, its logo, and VisualThinking.Space are trademarks of Thinking Schematics, Inc. These Terms grant you no rights to it except the limited right to use the Service as intended.

8. Feedback

If you send us feedback, ideas, or suggestions, we may use them freely to improve the Service without any obligation to you.

9. Data Loss & Backups

Your notes live on your device. Keeping backups is your responsibility.
You can back up individual universes using “Save as .verse”, found in the app’s Index.

The app keeps local rescue copies (.verse files) before risky storage operations — Help → Show Safety Copies. They never leave your device.
This is a beta — the software may malfunction, and local files can be lost, corrupted, or overwritten. We hold no copy and cannot recover them.
We are not responsible for any loss of Your Content.

10. Changes, Suspension & Termination

We may modify, suspend, or discontinue the Service (or your access) at any time, with or without notice.
You may stop using the Service at any time.
Sections that by their nature should survive (ownership, disclaimers, liability limits) survive termination.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL BE PRESERVED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINKINGSCHEMATICS, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify and hold ThinkingSchematics, Inc. harmless from claims arising out of Your Content or your misuse of the Service or violation of these Terms.

14. Changes to These Terms

We may update these Terms. If we make material changes, we’ll take reasonable steps to notify beta users. Continued use after changes means you accept the updated Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Disputes will be resolved in the courts located there.
